SC: Pactum Commissorium is Prohibited

“Pactum Commissorium is prohibited.” – Supreme Court. 

The SC emphasized that the prohibition is to protect borrowers from losing properties that may be worth more than their debt.

Furthermore, ownership can only be transferred through foreclosure and a public auction.
