Tax Avoidance vs. Tax Evasion

As stated in the case of Commissioner of Internal Revenue v Estate of Benigno P. Toda Jr. (GR. 147188, September 14, 20024), Tax Avoidance and Tax Evasion are the two most common ways used by taxpayers in escaping from taxation.

While the tax avoidance is legal and tax evasion is illegal in nature, the same jurisprudence had to define these two to further educate the taxpayers.
